The Harp Lab Contract Agreement

Rental terms and payment conditions

1. The Customer accepts all liabilities, both direct and indirect, associated with the rental of the instrument and agrees to hold The Harp Lab harmless from any action, damage, or loss arising out of the use or misuse of the instrument, tuning key, or case by themselves or other parties, whether knowingly or unknowingly.

2. In exchange for the use of this instrument and its accessories, the Renter agrees to pay the nominated rent amount indicated above to The Harp Lab via automatic deduction payments arranged through Stripe Pty. Ltd. and their DDR Service Agreement. These payments are to be made one month in advance for each rental term, as per the service agreement. The Renter acknowledges that a $20.00 dishonoured payment fee will be incurred for each failed payment attempt.

3. The rental instrument, tuning key, and case remain the property of The Harp Lab at all times.

4. The Renter agrees to submit a refundable damage/loss deposit of $250 to The Harp Lab prior to the commencement of the first rental period. This amount will be deposited into a separate Damage/Loss Deposit Account.

5. When the instrument and its accessories are returned in good condition at the end of the contracted rental period to The Harp Lab Studio, the Damage/Loss deposit will be refunded in full to the Renter.

6. The charge for loss or damage of a tuning key is $35. The Renter agrees that this amount may be deducted from their Damage/Loss deposit if the tuning key is lost or damaged.

7. The Renter agrees that their Damage/Loss deposit held in The Harp Lab’s Damage Deposit Account may be accessed by The Harp Lab under the following conditions:

a) If the instrument and/or its accessories are returned in a damaged condition. The Harp Lab reserves the right, at its sole discretion, to withhold any portion of the Damage/Loss Deposit necessary to repair the instrument and/or its accessories due to damage sustained during the rental period.

b) If there is any unpaid rent owing upon return of the instrument, including any time beyond the agreed rental period. This amount will be prorated to the date of return, in addition to a $50 late fee.

c) If the instrument and/or its accessories are unreturned for more than 30 days after the expiry of the rental period. In this case, the Renter agrees to compensate The Harp Lab for the full stated value of the instrument and its accessories, beyond the value of the Damage/Loss Deposit.

8. If pick-up of the rental instrument becomes necessary due to late payments or by request of the Renter, the Renter agrees to a $250 pick-up fee, which will be deducted from their Damage/Loss deposit. This fee may be adjusted at the discretion of The Harp Lab to recover all travel costs incurred. The Renter will arrange and agree on a time for the instrument to be picked up from the address provided in the rental form. The rental period will continue until the instrument is fully returned.

9. The Renter is responsible for paying The Harp Lab the replacement or repair costs of the instrument—whichever is lesser—if it is damaged, lost, or stolen during the rental period. The Renter must notify The Harp Lab within 48 hours of any such incident.

10. The initial rental period will be paid by the Renter after the Rental Agreement is signed (the signatory must be over 18 years old) and the Direct Debit Authorisation and DDR Service Agreement are completed. Bank and credit details must be verified by Stripe Pty. Ltd. All rental payments are non-refundable if the contract is cancelled by the Renter, unless a satisfactory mutual agreement is reached.

11. Subsequent rental payments must be made on or before the beginning of each new rental period and will be withdrawn automatically as per the Direct Debit Service Agreement and this Rental Contract, regardless of whether reminder notices are sent or received.

12. The Harp Lab reserves the right to demand the return of the instrument at any time. In such a case, rent will be prorated to the return date. The Renter agrees to return the instrument to The Harp Lab at their own expense, unless otherwise agreed upon.

13. The Renter agrees to maintain the instrument in the good condition it was in at the start of the rental period. Repairs due to damage are the responsibility of the Renter.

14. The Renter agrees to return the rental instrument and accessories to The Harp Lab in satisfactory condition at the end of the contract.

15. The Harp Lab is responsible for all normal maintenance of the instrument.

16. The Renter agrees not to lease, sell, loan, pawn, or otherwise dispose of the instrument.

17. If the Renter chooses to return the instrument and its accessories before the rental period concludes, they agree to pay the full rental fee for that period.

18. Termination of this agreement does not release the Renter from any outstanding rental payments or compensation for damage or loss of the instrument, tuning key, or chromatic tuner.

19. The Renter’s signature below indicates that they have read, understood, and agreed to all conditions in this contract, and agree to notify The Harp Lab within 7 days of any changes to the information provided in this Agreement.

PLEASE NOTE: THE HARP MUST BE RETURNED TUNED TO E FLAT MAJOR OR A FEE OF $100 WILL BE DEDUCTED FROM THE DAMAGE DEPOSIT
